Statement of Confidentiality
All information as to personal facts or circumstances of the information submitted to Ask the Doctor, obtained by NEA Clinic, its directors, officers, employees, agents, health care providers and practioners. servants, assigns, privies, trustees and/or any person acting on their behalf (collectively, "successors and assigns") shall be treated as privileged communications and shall be held strictly confidential. Submitted information, that includes personal facts or circumstances, shall not be divulged without written consent, provided that nothing herein shall prohibit the disclosure of information in summary, statistical, or other form which does not identify particular individuals.
NEA Clinic shall protect the confidentiality of all Ask the doctor records and other materials that are maintained in accordance with this Agreement. Except for purposes directly connected with the execution or performance of this Agreement, no information about or obtained from any Ask the Doctor question, answer or profile in possession of NEA Clinic and/or of its successors and assigns shall be disclosed in a form identifiable with the individual without the prior written consent of the individual
NEA Clinic's data safeguard program shall further conform to the data confidentiality and security requirements of state Medicaid agency policy and procedures, the Health Insurance Portability and Accountability Act (HIPAA), and all relevant state and federal requirements applicable to medical records.
NEA Clinic shall advise its successors and assigns that they are subject to these confidentiality requirements. Signed confidentiality statements from all successors and assigns shall be filed and maintained by NEA Clinic.
